Terms and Conditions — Text Messaging (SMS/MMS) Program

1. Program Description
David E. Hill, P.A. (“the Firm,” “we,” “us,” or “our”) offers a text messaging (SMS/MMS) program that allows the Firm to communicate with clients and prospective clients by text message about their legal matters and inquiries. Messages are transactional and case-related. They may include:
- Case and claim status updates;
- Appointment, hearing, deposition, mediation, and independent medical examination reminders;
- Requests for documents, records, or information needed for your matter;
- Confirmation that we received a document, call, or message from you;
- Responses to questions you send us by text.
We do not send marketing, promotional, or advertising text messages through this program.
2. Consent to Receive Messages
By providing your mobile telephone number to the Firm and affirmatively agreeing to receive text messages — through our website contact form, our client intake form, our written engagement agreement, or a written or recorded request to our office — you consent to receive text messages from David E. Hill, P.A. at the number you provided, including messages sent using automated technology.
Consent is not a condition of purchase, engagement, or the provision of legal services. You may decline text messaging and still be represented by the Firm, and we will communicate with you by telephone, email, or U.S. Mail instead.
You represent that you are the subscriber or the customary user of the mobile number you provide, and that you are authorized to consent to receive messages at that number. Please notify us promptly if your mobile number changes or is no longer yours.
3. Message Frequency
Message frequency varies. The number of messages you receive depends on the activity in your matter and on how often you communicate with us by text. There is no fixed number of messages per week or month.
4. Message and Data Rates
Message and data rates may apply for messages sent to you from us and to us from you. These charges are set by your wireless carrier and are your responsibility. For questions about your text plan or data plan, contact your wireless provider.
5. How to Opt Out
You can cancel the SMS service at any time. Simply text STOP to the number from which you received our message. Upon sending STOP, we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Opting out of text messages does not withdraw you from representation and does not affect any other communications with the Firm.
6. How to Get Help

7. Supported Carriers and Delivery
The program may be supported by all major U.S. wireless carriers, including AT&T, Verizon Wireless, T-Mobile, and their affiliates and resellers. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and to network availability, and is outside the Firm’s control.
8. Privacy and Confidentiality
Your mobile number and the content of your messages are handled in accordance with our Privacy Policy, available at https://www.myocalalawyer.com/privacy-policy
David E. Hill, P.A. does not sell, rent, trade, or share the mobile information, opt-in data, or consent of our users, clients, or prospective clients with any third party or affiliate for marketing or promotional purposes. Mobile numbers and message content are disclosed only to the messaging service providers that transmit messages on our behalf, solely for the purpose of delivering and supporting the messaging service.
Text messaging is not a secure or encrypted method of communication. Messages may be retained on your device and may be viewed by anyone with access to your device or wireless account. Please avoid sending highly sensitive information by text, and let us know if you prefer that we not discuss your matter by text message.
9. No Attorney-Client Relationship Created by Text
Sending a text message to the Firm, or receiving one from the Firm, does not by itself create an attorney-client relationship. An attorney-client relationship is formed only upon execution of a written engagement agreement between you and David E. Hill, P.A. Text messages are not a substitute for legal advice, and nothing in a text message should be relied upon as legal advice unless you are a client of the Firm and the message addresses your matter.
Do not use text messaging for emergencies or for time-sensitive deadlines. If a matter is urgent, call our office at (352) 690-9766.
10. Changes to These Terms
We may modify or terminate the text messaging program, or update these Terms and Conditions, at any time. Revised terms will be posted on this page with an updated “Last Updated” date and are effective when posted.
11. Governing Law
These Terms and Conditions are governed by the laws of the State of Florida, without regard to its conflict-of-laws provisions.
